Terms of Service

These Terms of Service ("Terms") govern your access to and use of PingPage's website, dashboard, APIs, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

2. Service Description

PingPage provides uptime monitoring, status page hosting, incident management, and subscriber notification services. We monitor endpoints you configure, automatically detect downtime, create incidents, and notify subscribers via email. The specific features available to you depend on your subscription plan.

3. Acceptable Use

You agree not to:

  • Use the Service to monitor endpoints you do not own or have permission to monitor
  • Attempt to probe, scan, or test the vulnerability of our systems
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service for sending spam or unsolicited communications
  • Circumvent usage limits or access controls
  • Resell or redistribute the Service without our written consent
  • Use the Service for any illegal or unauthorized purpose

4. Organizations and Teams

You may create organizations and invite team members. Organization owners and admins are responsible for managing team access and permissions. When you invite someone to your organization, they gain access to your monitors, incidents, and subscriber data according to their assigned role (owner, admin, or member).

5. Billing and Payments

Paid plans are billed through Paddle, our payment processor and Merchant of Record. Paddle handles all payment processing, invoicing, and tax compliance. By subscribing to a paid plan, you also agree to Paddle's terms of service. Subscriptions renew automatically unless cancelled before the renewal date.

6. Status Pages

Status pages hosted on PingPage are publicly accessible at your organization's subdomain. You are responsible for the accuracy of the information displayed on your status page. We reserve the right to remove status pages that contain offensive, misleading, or illegal content.

7. Service Availability

We strive to maintain high availability of our platform but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable advance notice. We are not liable for temporary unavailability due to maintenance, updates, or circumstances beyond our control.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. You retain ownership of the data you provide to us. We process it only as necessary to deliver the Service.

9. Limitation of Liability

To the maximum extent permitted by law, PingPage shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

10. Termination

You may cancel your account at any time. We may suspend or terminate your account if you violate these Terms or if required by law. Upon termination, your data will be deleted in accordance with our Privacy Policy. Any outstanding fees remain payable.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
